DK Derby is an educational and entertainment application. It is not a psychological assessment tool and should not be used as a substitute for professional evaluation.

1. Acceptance of Terms

By accessing or using Dunning-Kruger Derby ("DK Derby"), you agree to be bound by these Terms of Use. If you do not agree to these terms, you may not use the application. Your continued use of DK Derby constitutes your acceptance of any updates or modifications to these terms.

2. Description of Service

DK Derby is a daily confidence calibration game designed for educational and entertainment purposes. The application presents questions and asks users to rate their confidence in their answers, producing a calibration score that reflects the alignment between confidence and accuracy. DK Derby is not a clinical diagnostic tool, a psychological assessment, or a substitute for professional evaluation of any kind.

3. User Conduct

You agree to use DK Derby only for its intended purpose. You may not:

Use automated systems, bots, or scripts to access or interact with the application. Attempt to reverse-engineer, decompile, or extract the source code, scoring algorithms, or question databases. Interfere with or disrupt the application's infrastructure, servers, or networks. Misrepresent your identity or impersonate another user. Use the application to harass, abuse, or harm others. Redistribute, resell, or sublicense any part of the application or its content.

4. Intellectual Property

All content within DK Derby... including questions, answer explanations, scoring algorithms, calibration methodologies, visual design, illustrations, and copy... is the intellectual property of 98%Chimp and is protected by applicable copyright and intellectual property laws. You may not reproduce, distribute, modify, or create derivative works from any content within the application without prior written permission from 98%Chimp.

5. Disclaimer of Warranties

DK Derby is provided on an "as is" and "as available" basis without warranties of any kind, either express or implied. 98%Chimp does not warrant that the application will be uninterrupted, error-free, or free of harmful components. The application is designed for educational and entertainment purposes only. No content within DK Derby should be interpreted as professional psychological, medical, or clinical advice. Your calibration scores reflect game performance and are not a measure of intelligence, competence, or psychological fitness.

6. Limitation of Liability

To the fullest extent permitted by applicable law, 98%Chimp and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use DK Derby. This includes, without limitation, damages for loss of data, loss of profits, or any other intangible losses, even if 98%Chimp has been advised of the possibility of such damages. In no event shall 98%Chimp's total liability exceed the amount you paid to access the application in the twelve months preceding the claim.

7. Changes to Terms

98%Chimp reserves the right to modify these Terms of Use at any time. Material changes will be communicated through the application or via the email address associated with your account. Your continued use of DK Derby after such notification constitutes acceptance of the updated terms. We encourage you to review these terms periodically.
