Please read these Terms of Use ("Agreement") carefully before using the www.98chimp.ca website or any product developed by 98% Chimp Inc.

1. Acceptance of Terms

By accessing our website or downloading, installing, or using any of our products ("the Products"), you agree to be bound by this Agreement. If you do not agree to these terms, do not use our Products.

If you are using a Product on behalf of a minor child, you represent that you are the parent or legal guardian and accept this Agreement on behalf of yourself and your child.

2. Scope

This Agreement covers the www.98chimp.ca website and all products developed by 98% Chimp Inc., including DK Derby, BrainFit, Unison, Loomi, and Meelo. Individual products may have supplementary terms that address product-specific usage. Where product-specific terms exist, they layer on top of this Agreement.

3. License Grant

Subject to your compliance with this Agreement, we grant you a limited, non-exclusive, non-transferable, revocable license to:

Access the www.98chimp.ca website for personal, informational purposes
Download and install our apps on devices you own or control
Use our Products for personal, non-commercial purposes

4. Restrictions

You agree NOT to:

Copy, modify, or distribute our Products or their content
Reverse engineer, decompile, or disassemble any Product
Remove any copyright, trademark, or proprietary notices
Use any Product for commercial purposes without authorization
Share your account credentials with others
Circumvent any access controls or usage limits
Use any Product in a way that violates applicable laws

5. Content Ownership

Our Content

All content within our Products... including stories, narrations, music, artwork, questions, assessments, algorithms, and interface designs... is owned by 98% Chimp Inc. or our licensors and is protected by copyright and other intellectual property laws. You may not reproduce, distribute, or create derivative works without our written permission.

Your Use

You may use our content solely for personal, non-commercial purposes through the Products. Downloaded content for offline use remains subject to this Agreement.

6. Subscriptions & Purchases

In-App Purchases

Our Products may offer subscriptions or one-time purchases. All purchases are processed through the Apple App Store and are subject to Apple's terms and conditions.

Refunds

Refund requests must be directed to Apple, as they process all payments. We do not have access to your payment information.

Price Changes

We reserve the right to change subscription prices. You will be notified of any price changes before your next billing cycle.

7. Account Termination

We may suspend or terminate your access to our Products if you:

Violate this Agreement
Engage in fraudulent or illegal activity
Abuse or misuse any Product

You may delete your account at any time through the app settings or by contacting us.

8. Disclaimer of Warranties

OUR PRODUCTS ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT:

Any Product will be uninterrupted or error-free
Any Product will meet your specific requirements
Any content will achieve particular results

Our Products are designed as tools for self-awareness, learning, and development. They are not medical devices and are not intended to diagnose, treat, cure, or prevent any condition. Meelo is an assessment tool designed to support... not replace... professional clinical judgment.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, 98% CHIMP INC. SHALL NOT BE LIABLE FOR:

Any indirect, incidental, special, or consequential damages
Loss of data, profits, or goodwill
Any damages exceeding the amount you paid for the applicable Product in the 12 months preceding the claim

10. Indemnification

You agree to indemnify and hold harmless 98% Chimp Inc. and its officers, directors, employees, and agents from any claims, damages, or expenses arising from:

Your use of our Products
Your violation of this Agreement
Your violation of any third-party rights

11. Children's Safety

Loomi is designed for children ages 0-6. We are committed to providing safe, age-appropriate content. All stories and affirmations are reviewed for child appropriateness. Loomi contains:

No advertisements
No in-app purchases accessible to children
No external links accessible to children
No social features or user-generated content

Our other Products (DK Derby, BrainFit, Unison, Meelo) are designed for adults and are not intended for use by children under 13.

12. Privacy

Your use of our Products is also governed by our Privacy Policy. Please review it carefully.

13. Updates

We may update our Products from time to time. Some updates may be required for continued use. We are not obligated to provide updates, support, or maintenance.

14. Governing Law

This Agreement is governed by the laws of Canada, without regard to conflict of law principles. Any disputes shall be resolved in the courts of British Columbia, Canada.

15. Changes to This Agreement

We may modify this Agreement at any time. Continued use of our Products after changes constitutes acceptance of the modified terms. Material changes will be communicated through our Products, website, or via email.

16. Severability

If any provision of this Agreement is found unenforceable, the remaining provisions will continue in full force and effect.

17. Entire Agreement

This Agreement, together with our Privacy Policy and any product-specific terms, constitutes the entire agreement between you and 98% Chimp Inc. regarding use of our Products.
